1) By uploading photos, you represent and warrant that you are the copyright holder of the images or that you possess the necessary rights to grant us the rights of use described in sections 2 and 3, and that no third-party rights preclude such use. In particular, you confirm that all recognizable persons depicted in the images consent to the uses described in these terms and conditions; if minors are depicted, you also have the consent of their legal guardians. You further warrant that the content of the image files you submit does not violate any applicable laws.

2) By uploading photos, you grant Camping Wagner a simple, unrestricted (in terms of time and location), and royalty-free right to use the uploaded photos for Camping Wagner’s public relations and marketing purposes. We may also use the images while crediting the account name you provided. You may revoke this grant of rights at any time without providing a reason, effective for the future (e.g., by email to Datenschutz@campingwagner.de). Revocation means that we will no longer use the photos in this manner. Use of the photos prior to revocation remains legally possible and permissible.

3) The photos may be used digitally and analog for the purposes specified in Section 2, in particular on our websites, in our stores, in print materials, and on our social media channels (e.g., Facebook, Instagram, YouTube, TikTok, X), including the storage in databases required for this purpose. We may edit the photos to the extent customary for this purpose (e.g., cropping, color and brightness adjustments, filters, combination with text, graphics, or other images), provided that this does not infringe upon your legitimate intellectual and personal interests in the work; the images will not be distorted. The photos will only be disclosed to third parties to the extent necessary to fulfill the aforementioned purposes (e.g., to technical service providers or the aforementioned platforms in connection with publication).

4) The rights of use are granted free of charge. You will not receive any compensation for this, not even in the form of discounts, merchandise, or cash.

5) Meta (i.e., the Instagram and Facebook platforms) has no connection whatsoever to any promotions that may be associated with uploaded photos. These promotions are neither sponsored, endorsed, nor organized by Meta.

6) If you knowingly provide false information regarding copyrights, usage rights, or the consent of persons depicted, and Camping Wagner suffers damage as a result, you will be liable in accordance with applicable law. In this case, you shall indemnify us against any valid claims by third parties, including reasonable legal defense costs, to the extent that you are responsible for the infringement.
